This Privacy Policy ("Policy") outlines the rules for processing personal information that the administration of the nebux.icu service ("we," "Administration") may collect about Users ("User" or "you") in connection with your use of the nebux.icu service ("Service"). It defines the types of information collected, methods and means of information collection, purposes, measures to ensure information security, as well as the User's rights regarding their personal information ("Personal Information"), which refers to any information about a specific or identifiable individual, as defined in the User Agreement of the Service.

By using the Service, the User hereby consents to the processing of their Personal Information in accordance with this Privacy Policy. User actions aimed at using the Service constitute an unconditional acceptance of the terms of this Policy and the conditions stipulated herein for the processing of their Personal Information. We strongly urge you to read this Policy and ensure that you fully understand and agree to it before you start using our Service. If you have not read it completely, do not understand anything, or do not accept the terms of the Policy, you must immediately stop using the Service.

The User guarantees that, in accordance with their jurisdiction, they have reached the age of legal capacity allowing them to independently manage their personal information (but not less than 16 years old) or the User can provide the appropriate permission for the handling of their personal information from their legal representatives in the prescribed manner and form.

Please note that, in accordance with applicable law, you are not obliged to provide us with any personal information. However, the provision of such information is a mandatory condition for using our Service. By accepting this, you confirm, guarantee, and agree that any information you provide to us is provided of your own free will, is specific, unambiguous, and corresponds to your true intention to use your data for the purposes described in this Policy.

You may withdraw your consent to the processing of your personal information at any time. We ensure that the procedure for withdrawing consent is as simple as the procedure for giving consent. The withdrawal of consent does not affect the lawfulness of processing Personal Information based on consent prior to its withdrawal.

  • 1. Collected Personal Information

    • 1.1. In our activities, we adhere to the standards established by the Council of Europe Directives on the collection and storage of personal data (GDPR).

      1.2. In accordance with the principle of "data minimization," we collect Personal Information only to the extent necessary for the use of the Service and the achievement of the purposes of its collection.

      1.3. During the use of the Service by the User, we collect two types of Personal Information: Personal Information and Anonymous Information.

      • 1.3.1. Personal Information: This information includes individual information that identifies a specific User, which the User provides to us during the Registration process.

        1.3.2. Anonymous Information: Anonymous Information is information that does not identify a specific User and is collected automatically during Registration and use of the Service.

        • Anonymous Information may include:

          1. - Information obtained through cookies, pixel tags, web beacons, browser analysis tools, and web server logs, as well as similar technologies and tools.
          2. - Information about the devices that the User uses to access the Service, including the operating system type, device model, browser type, system settings, including information about the language used by the User's system, geolocation data (country/region determination), the User's device time zone, and the network operator.
          3. - Server logs that record IP addresses of the devices that the User uses to interact with the Service, access time, the User's sequence of actions within the Service, session information, including response time and loading errors.
          4. - Information from the User's social network account (depending on the privacy settings set by the User for their social network account), as this allows us to obtain information about your interests and preferences.
          5. - Other non-identifying User information depending on the permissions provided by the User.

        1.4. The User acknowledges and agrees that in some cases, we may request additional information about the User, as well as copies of documents to confirm the provided information and make any other requests when necessary based on reasonable assumptions and legitimate interests.

  • 3. Purposes of collecting personal information

    • We use Personal Information for the following purposes.

      3.1. When registering for the Service, the User/Advertiser guarantees that.

      • 3.1.1. Providing access to the Service for its further operation.

        3.1.2. Improving the Service, enhancing its usability, and adjusting necessary settings based on general or individual preferences, user experience, or encountered difficulties.

        3.1.3. Providing technical support, feedback, including sending notifications, inquiries, and information related to the use of the Service (notifications about updates, security information, changes to our rules and terms of use of the Service).

        3.1.4. Creating aggregated statistical information, including analytics and monitoring trends in the use of the Service and users' actions within the Service.

        3.1.5. Sending promotional newsletters to your email address and displaying advertising materials within the Service about products, services, promotions, events, and other news and information that we believe will be of interest to the User. You can opt-out of receiving promotional messages to your email address using the "unsubscribe" option provided in such messages.

        3.1.6. Preventing fraud or violations of applicable laws, particularly to detect, investigate, and prevent fraudulent transactions and other illegal activities and protect our rights and property, as well as the rights and property of other users and third parties.

        3.1.7. Complying with any applicable legislation.

        3.1.8. Fully and independently ordering Services using the advance payment funds transferred to the Advertiser's Account and/or Ad Balance.

      3.2. The User's Personal Information will not be used for purposes other than those stated above.

      3.3. The User confirms that the purposes of using their Personal Information correspond to their interests, and the consent to the processing of Personal Information expressed by the User when starting to use the Service is given for each processing purpose specified in clause 3.1 of the Agreement.

  • 4. Disclosure of personal information

    • 4.1. We undertake not to disclose the User's Personal Information to third parties, except in cases when:

      • 4.1.1. The User has given explicit and specific consent to disclose their Personal Information.

        4.1.2. Such transfer of information is necessary for the User's use of the Service or for the performance of the User Agreement or other mandatory documents regulating the relationship between us and the User.

        4.1.3. When such transfer of information is necessary for the operation and functionality of the Service (transferring information to hosting, communication, and content delivery networks, data protection and cybersecurity services, billing and payment processing services, fraud detection and prevention services, web analytics, email distribution, and monitoring the Service's status, including performance measurement and data optimization, marketing and advertising services), third parties (recipients of Personal Information) may receive or otherwise have access to the User's Personal Information, in whole or in part, depending on the role and purposes of each such party in maintaining the functionality or improvement of the Service; moreover, they may use the received information only for the purposes specified in this Policy.

        4.1.4. The transfer of Personal Information is carried out in accordance with applicable law in response to requests from authorized recipients of such information (court orders and requests from law enforcement agencies) when we are obliged to disclose such information if we reasonably believe that the law requires us to do so.

        4.1.5. There is a transfer of ownership or control rights over all or part of the Service to a new owner.

        4.1.6. The transfer of Personal Information is carried out to protect our rights and legitimate interests or the rights and interests of third parties in cases where the User violates this Privacy Policy or other mandatory documents regulating the relationship between us and the User, and applicable laws. The storage and processing of Users' Personal Information are carried out either directly by us or with the assistance of third parties specializing in information storage, and such entities are obligated to protect and preserve the Personal Information in accordance with this Privacy Policy.

      5.2. In the event that we and the User are located in different jurisdictions, by accessing or using the Services or otherwise providing us with their Personal Information, the User agrees to the processing and cross-border transfer of their Personal Information to the European Union, and we guarantee that we will take appropriate measures to protect the User's Personal Information in accordance with this Privacy Policy and applicable law.

      5.3. We strive to protect and preserve Users' Personal Information in accordance with international industry standards and do not consider any lesser legal requirements compared to the User's jurisdiction.

  • 6. Use of tracking technologies

    • 6.1. We use certain monitoring and tracking technologies to maintain, provide, and improve the operation of our Service on an ongoing basis and to ensure a comfortable user experience. By default, we use several such technologies for session and user authentication, security purposes, preserving user preferences (e.g., default language and settings), connection stability, monitoring the performance of our Service and marketing campaigns, as well as for providing and enhancing our Services.

  • 7. User Rights

    • 7.1. Within the scope of this Privacy Policy, each User has the following rights regarding their Personal Information:

      • 7.1.1. Right to withdraw consent for the processing of Personal Information. The User has the right to withdraw their consent at any time. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. The Service provides an easy way to withdraw consent. Therefore, the User has the option to request the deletion of their account at any time, and we will delete the account within a reasonable time after receiving the corresponding request.

The User has the right to request and we are obliged to erase the User's Personal Information without undue delay if: the personal information is no longer necessary for the purposes for which it was collected; the data subject withdraws their consent, which was the basis for the data collection; the personal data has been unlawfully processed; the personal data must be erased in accordance with the law.

  • 8. Storage Period of Personal Information

    • 8.1. We store your Personal Information for the entire duration of your use of the Service (activity of your account) or until such time when we no longer need the data for providing the Service, or when a longer retention period is required (if we are obligated to retain it for a longer period under applicable law or for the purpose of resolving disputes regarding our Users, preventing fraud and abuse, and/or protecting our legitimate interests).

  • 9. Information Security

    • 9.1. We hereby guarantee that we take all necessary and sufficient organizational and technical measures, in accordance with applicable laws, to protect the User's Personal Information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, and other unlawful actions by third parties. In our operations, we employ industry-standard practices to protect the User's Personal Information and strive to maximize its confidentiality and security. The protection of Personal Information is embedded by default at the design level of the Service during its development. All third parties who have access to Personal Information and participate in the process of providing access to the Service for the User adhere to equally strict security measures for Personal Information.

      9.2. However, we cannot guarantee absolute protection, and therefore we urge you to exercise caution, set a strong password for your account, and avoid disclosing any sensitive information that could cause significant harm if disclosed.

      9.3. In the event of any breach of the confidentiality of Personal Information, we take all measures within our control to mitigate or minimize possible negative consequences and promptly notify the competent supervisory authorities and the User of the incident, providing all available information about the breach of confidentiality. Such incidents are recorded in a special incident register, which we are obliged to maintain in accordance with applicable law.

      9.4. In this Privacy Policy, a breach of the confidentiality of Personal Information refers to a security incident that leads to accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access to transmitted or processed Personal Information.

  • 10. Amendment and Interpretation of the Privacy Policy

    • 10.1. This Privacy Policy, its interpretation, and any claims and disputes related to it are governed, interpreted, and enforced exclusively in accordance with the laws of the country of our incorporation, without regard to the principles of conflict of laws.

      10.2. By accepting this, you agree that any disputes arising shall be resolved exclusively by courts located at our place of establishment.

      10.3. We reserve the right to make changes to the Privacy Policy at any time. In the event that we consider the changes to be substantial (in our own reasonable discretion), we will notify you before the changes take effect; otherwise, we are not obliged to provide such notification.

If you make a request electronically, and unless otherwise requested by you, we provide the response in a widely used electronic format at our own discretion.

      11.4. If a user's requests are clearly unfounded or excessive, particularly due to their repetitive nature, we may refuse to act on the request.

      11.5. In cases where we have reasonable doubts about the identity of the person making the request, we may request additional information necessary to confirm the user's identity.
